The Immigration Advisory Service is able to offer bespoke advice and training services to employers and educational institutions under the new Points Based System. With an open and collaborative style we can deliver a tailored package of services to all our clients

The Points Based System requires all employers and educational institutions that wish to employ non-EEA migrant workers or sponsor overseas students to be registered as licenced sponsors with the UK Border Agency. Once licenced the sponsor is able to issue a sponsorship certificate to the prospective migrant worker or student. The certificate acts as an undertaking to meet the conditions of the scheme and places very significant responsibility on the sponsor.

When applying for a licence of sponsorship the sponsor needs to ensure their administrative procedures and systems comply with the UKBA requirements for a sponsor. The UKBA will also check ongoing compliance at any time and any failure on the part of the sponsor may result in a downgrade of their rating as a sponsor or a withdrawal of the licence itself. In addition to this under the new system of civil penalties the sponsor could face a maximum fine of £10,000 if found to be negligently employing an illegal employee or even be prosecuted and incur an unlimited fine and imprisonment if found to be knowingly doing so.

The Points Based System requires sponsors to maintain specific records to comply with the scheme, and also requires sponsors to update the UK Border Agency of various events and change of circumstances of those that have been sponsored through the new ‘Sponsor Management System’.
